Let’s say you’ve built a life together, paid down the mortgage on your family home, and feel secure knowing that if something happens to you, then your spouse will inherit the house without any hassle.

After all, you’re married, and that should be enough, right?

But sometimes 1 missing phrase on your property deed can trap your family’s biggest asset in a long costly probate process, even if you’re married, living together, and sharing all the bills.

Why Marriage Alone Does Not Protect Your Home

When a homeowner dies, the exact wording on the deed (called the “title”) decides what happens to the property.

Many couples own their home as “tenants in common” or simply as married individuals without special survivorship language.

In those cases, the deceased spouse’s share does not pass directly to the survivor.

Instead, it becomes part of the estate and usually must go through probate which is the court process that validates a will (or follows state rules if there is no will) and distributes assets.

So even if you have a will leaving everything to your spouse, probate is often still required unless the deed includes the right of survivorship.

What Really Happens During Probate

Across the United States, the average case lasts 9 to 18 months, and simple estates might finish in 6 to 12 months, while complicated ones can stretch for years.

While probate is ongoing, your home is essentially frozen:

  • It cannot be sold without court permission
  • Refinancing becomes extremely difficult or impossible
  • Major repairs or decisions get delayed
  • The surviving spouse may not be able to access equity when needed

Legal and administrative costs add up fast with fees typically ranging from 3% to 7% of the estate’s value, plus court costs, appraisals, and executor fees.

For a $500k home, that can easily mean $15k to $35k or more lost before your spouse gains clear ownership.

Thus, your grieving partner must deal with paperwork and court deadlines at the worst possible time.

The Fix Almost Nobody Checks

Check your property deed for specific wording such as:

  • Joint Tenants with Right of Survivorship (often abbreviated JTWROS), which is available in most states and means the surviving owner automatically becomes the sole owner, skipping probate entirely.
  • Tenants by the Entirety is offered in about half the states for married couples only and it works like JTWROS but adds extra protection from creditors.
  • Community Property with Right of Survivorship is mostly used in community property states like California, Texas, and Arizona; it provides survivorship benefits plus potential tax advantages.

If your deed does not include one of these phrases then the home is at risk of probate.

How to Check and Update Your Deed Today

  1. Obtain a copy from your county recorder’s office
  2. Look for “joint tenants” “right of survivorship” or your state’s equivalent terms
  3. If needed, a real estate attorney or title company can draft a new deed adding survivorship language
  4. File it officially with your county to make the change legal
