CBD Listicle: 7 Important Facts About CBD and Intoxicating Hemp

Fact #1: Despite appearances, the Consumable Hemp industry does not always appear to be one unified entity. Is it possible that it’s two separate industries, each with a different mission and goals?
You could make a case that the Hemp industry is actually two separate and distinct industries: CBD Wellness products and Intoxicating Hemp.
CBD Wellness products focus on improving health and well-being. They cannot get you high. Intoxicating Hemp helps you attain altered states of varying types and degrees. A pleasant by-product is that they can help you relax and de-stress, which is always welcome and good.
Currently, most CBD Wellness products are considered legal. The only exception might be Full-spectrum CBD, and that depends on the state. Intoxicating Hemp has different degrees of legality depending on the state, or the status of a court case(s). This is not an especially encouraging or productive situation.
Fact #2: Regulating Hemp Flower products is a highly political issue in the Federal government and many states. We need to talk about it.
Both industries are in desperate need of smart, responsible, reality-based regulation. One model to consider is Cannabis Lawyer Rod Kight’s Three Pillars:
“(1) limiting access by minors, (2) standardized quality control in production and manufacturing of cannabinoid products, and (3) uniform labeling requirements to provide sufficient information that adults can make an informed decision about the cannabinoid products they use.”

In November 2025, the US Congress created a regulatory time bomb/nightmare aimed directly at the US Hemp industry. This legislation specifies that, within one year of enactment, a specific standardized weight will apply to total THC — including delta-8 and other isomers*.
Legal hemp products will be limited to a total of 0.4 milligrams per container of total THC or any other cannabinoids with similar effects*.
This dumb-as-dirt piece of legislation effectively cripples the American Hemp industry as it considers as much as 95% of all consumable Hemp products illegal.
Another consequence of that dumb-as-dirt legislation is that several states are mimicking the formulation restrictions. This was/ is not a smart idea.
No matter what certain politicians might think, Intoxicating Hemp is not going away. All this approach does is drive Intoxicating Hemp products underground. They will be totally unsupervised and unregulated, and potentially more dangerous to users than current versions.
This has the potential of becoming a very bizarre and possibly more destructive 21st-century version of the Paraquat herbicide fiasco/nightmare of the 1970s and 1980s. In all cases, smart, responsible, reality-based regulation is an infinitely better solution and is attainable.

Much like CBD Oil, real resources, including time and money, have to be invested in researching this class of products to determine whether they offer any other quantifiable benefits.
Fact #7: Let’s talk about Drug Screening
If you’re in a drug testing (AKA drug-screening) situation, there is a fairly strong possibility that you will get tested for Delta 8, Delta 9, or Delta 10 THC. Marijuana typically contains a significant percentage of Delta 9 THC.
Intoxicating Hemp contains varying amounts of Delta 8 or Delta 10 THC. If you currently don’t smoke or ingest edibles with significant amounts of Marijuana, use Intoxicating Hemp, but take Full-spectrum CBD Oil products, this test could still be a problem. Why? Full-spectrum CBD includes traces of Delta 9 THC.
