Washington teacher charged with incest after allegedly having sex with two teenage boys she adopted

Under Washington law, first-degree incest is a class B felony punishable by up to 10 years in prison and a $20,000 fine.

A Washington state teacher who built a public profile advocating for foster children has been arrested on incest charges after authorities accused her of having sexual contact with two teenage boys whom she adopted.

Amber Swain, 35, of Newport, was booked into jail Tuesday on charges of ***first- and second-degree incest*** following an investigation, the Pend Oreille County Sheriff’s Office said.

Swain worked as a teacher and director at Pend Oreille River School, the Newport School District’s alternative high school.

She was placed on administrative leave after the district learned of her arrest, The Spokesman-Review reported.

The investigation began in May after the Washington State Department of Children, Youth, and Families contacted the sheriff’s office regarding a possible sexual abuse case involving two teenage males.

Law enforcement was also shown text messages between Swain and one of the teenage boys, the news station reported.

Documents show that during one of the teens’ interviews, he admitted to having a sexual relationship with Swain before he turned 18. The teen told investigators that the two had sex “plenty of times” — even as recent as two days before the interview with law enforcement took place, KREM-TV reported.

The prosecuting attorney also claimed that Swain admitted to law enforcement that she had sex with one of the boys, but said it happened after he turned 18. However, she also allegedly told deputies that she “could have her timeline messed up.”

The other teen victim told detectives that he touched Swain multiple times while they were in bed together.

The district released the following statement:

“While we cannot say much at this time, we can unequivocally and firmly state that we take these matters very seriously. We are working closely with law enforcement as they continue their investigation into this matter.

During this time, as a district, we will continue to support our students, families, and one another. If you have a student that has been affected by this news, we ask that you reach out to your son or daughter’s school so they can speak to an adult.”

Pend Oreille County Prosecuting Attorney Dolly Hunt asked a judge to impose $50,000 bail for Swain, citing public safety concerns.

Swain’s public defender, Brett Billingsley, asked that his client be released, citing her lack of a prior criminal history and arguing that concerns about public safety could be addressed by Swain living in a separate residence from the teens.

Swain was released on Thursday after posting $20,000 bond, under strict conditions that prohibit contact with anyone under 18, require her to remain in Washington state, and mandate regular contact with legal counsel.

The investigation is ongoing.
