Poštovani,

Obraćam Vam se povodom nekoliko nedavnih objava koje su objavili lučki i turistički akteri, kao i lokalni mediji (Port of Kotor, Travel Montenegro, Allegra Port Agent, Radio Kotor, Adria TV) u vezi sa prisustvom i prihvatanjem broda TS Shtandart (MMSI 518999255) u luci Kotor i u Boki Kotorskoj, Crna Gora, tokom maja 2026. godine.

Ove komunikacije odražavaju značaj lučke, kulturne i turističke aktivnosti povezane sa ovim brodom.

Ovo pismo ima za cilj da skrene Vašu pažnju na primjenjivi regulatorni okvir na nivou Evropske unije. Lučke vlasti i agenti se uobičajeno očekuje da obezbijede usklađenost sa primjenjivim režimima sankcija prije prihvatanja uplovljavanja brodova.

TS Shtandart potpada u opseg restriktivnih mjera Evropske unije u vezi sa situacijom u Ukrajini. Ovaj režim posebno uključuje član 3ea Uredbe Savjeta (EU) br. 833/2014 [1], koji propisuje:

  1. Zabranjeno je omogućiti pristup, nakon 16. aprila 2022. godine, lukama, i nakon 29. jula 2022. godine, prevodnicama na teritoriji Unije, bilo kojem plovilu registrovanom pod zastavom Rusije, kao i takvim plovilima da pristupaju lukama i prevodnicama, uz izuzetak pristupa prevodnicama u svrhu napuštanja teritorije Unije…
  1. Stav 1 se primjenjuje na plovila koja su promijenila svoju rusku zastavu ili registraciju u zastavu ili registar bilo koje druge države nakon 24. februara 2022. godine.
  1. Za potrebe ovog člana, sa izuzetkom stava 1a, pojam „plovilo“ znači: (a) brod koji potpada pod relevantne međunarodne konvencije, uključujući replike istorijskih brodova…

Ovaj okvir direktno reguliše pristup lukama EU i pružanje lučkih usluga brodovima na koje se odnosi. Uredba ne uslovljava primjenu restrikcija nacionalnošću vlasnika ili strukturom upravljanja brodom. Međutim, propisuje da promjena zastave ne oslobađa od primjene restriktivnih mjera.

Sud pravde Evropske unije (CJEU) je zaprimio predmet koji su pokrenuli gđa Mariia Martus, Martus TV GmbH i g. Vladimir Martus u vezi sa sporom o primjeni ovih mjera. On je potvrdio njihovu primjenjivost na TS Shtandart u svojoj odluci od 22. avgusta 2025. godine [2].

Nadalje, potrebno je naglasiti da situacija sa TS Shtandart nije lokalno ili izolovano pitanje. Radi se o međunarodnom predmetu koji prate evropske institucije i u koji su uključene brojne nacionalne vlasti, što se ogleda u incidentima iz 2025. godine i nedavnoj naredbi komandujućih oficira francuskih pomorskih snaga u Sredozemlju, Atlantiku i Engleskom kanalu i Sjevernom moru [3].

Crna Gora, kao zemlja kandidat, formalno se uskladila sa odlukama Savjeta EU o sankcijama u vezi sa Ruskom Federacijom i obavezala se da ih sprovodi kroz nacionalne politike.

„Zemlje kandidati Sjeverna Makedonija, Crna Gora, Albanija, Ukrajina, Republika Moldavija i Bosna i Hercegovina, kao i zemlje EFTA Island, Lihtenštajn i Norveška, usklađuju se sa ovom odlukom Savjeta. One će obezbijediti da njihove nacionalne politike budu usklađene sa ovom odlukom Savjeta. Evropska unija prima na znanje ovu obavezu i pozdravlja je.”

U ovom kontekstu, planirana uplovljavanja TS Shtandart u Crnu Goru između 30. juna i 3. avgusta 2026. godine zahtijevaju, unaprijed, provjeru usklađenosti sa primjenjivim pravnim okvirom. Isto važi i za eventualne događaje i lučke usluge u vezi sa ovim brodom.

Provisionalni program TS Shtandart dostupan je u prilogu kao i na njegovom veb-sajtu [5].

Neophodna je hitna komunikacija sa operaterom broda kako bi se anticipirao svaki rizik neusklađenosti sa okvirom restriktivnih mjera Evropske unije. To bi omogućilo dovoljno vremena za izradu alternativnog programa, čime bi se izbjegle komercijalne i finansijske posljedice otkazivanja u posljednjem trenutku.

Sa svoje strane, to bi omogućilo nadležnim organima i ekonomskim ili kulturnim akterima u Crnoj Gori da ne ulaze u obaveze koje bi mogle biti potencijalno štetne.

Ova komunikacija je dostavljena u svrhu informisanja o riziku. Unaprijed zahvaljujem na pažnji koju ćete posvetiti ovom pitanju i ostajem na raspolaganju za svaku dalju komunikaciju ili dostavljanje prateće dokumentacije.

Ljubazno bih Vas takođe zamolio da navedete:

  • da li je izvršena procjena usklađenosti u vezi sa članom 3ea Uredbe Savjeta (EU) br. 833/2014;
  • da li je u toku interna procedura provjere ili razmatranja;
  • koji je subjekt nadležan za vođenje ovog predmeta.

The TS Shtandart is planning to return to the ports of Montenegro in the summer of 2026, despite the European sanctions that the country claims to be implementing and which prohibit such port calls. Port authorities and agents have been formally alerted to the associated risks.

Madam, Sir,

I am writing to you following several recent publications issued by port and tourism stakeholders as well as local media outlets (Port of Kotor, Travel Montenegro, Allegra Port Agent, Radio Kotor, Adria TV) concerning the presence and reception of the vessel TS Shtandart (MMSI 518999255) in the port of Kotor and in the Bay of Kotor, Montenegro, during May 2026.

These communications reflect the importance of the port, cultural and tourism activity linked to this vessel.

This letter nevertheless aims to draw your attention to the applicable regulatory framework at the level of the European Union.

The TS Shtandart falls within the scope of European Union restrictive measures related to the situation in Ukraine. This regime notably includes Article 3ea of Council Regulation (EU) No 833/2014 [1], which provides:

  1. It shall be prohibited to provide access, after 16 April 2022, to ports and, after 29 July 2022, to locks in the territory of the Union to any vessel registered under the flag of Russia, and for such vessels to access ports and locks, with the exception of access to locks for the purpose of leaving the territory of the Union…
  1. Paragraph 1 shall apply to vessels that have changed their Russian flag or their registration to the flag or register of any other State after 24 February 2022.
  1. For the purposes of this Article, with the exception of paragraph 1a, a “vessel” means: (a) a ship falling within the scope of the relevant international conventions, including replicas of historical ships

This framework directly governs access to EU ports and the provision of port services to the vessels concerned. The Regulation does not make the application of restrictions dependent on the nationality of the owner or on the vessel’s management structure. However, it specifies that a change of flag does not exempt a vessel from the applicable restrictive measures.

The Court of Justice of the European Union (CJEU) has been seized by Ms Mariia Martus, Martus TV GmbH and Mr Vladimir Martus in relation to litigation concerning the implementation of these measures. It confirmed their applicability to the TS Shtandart in its order of 22 August 2025 [2].

Furthermore, it should be noted that the situation of the TS Shtandart is not a local or isolated matter. It is an international case followed by European institutions and involving the intervention of several national authorities, as illustrated notably by the incidents of 2025 and the recent order issued by the commanders-in-chief of the French naval forces in the Mediterranean, the Atlantic, and the English Channel–North Sea [3].

Montenegro, as a candidate country, has formally aligned itself with EU Council Decisions on sanctions regarding the Russian Federation and has committed to ensuring their implementation through national policies. Port authorities and agents are typically expected to ensure compliance with applicable sanctions regimes prior to accepting port calls.

  • *“The candidate countries North Macedonia, Montenegro, Albania, Ukraine, Republic of Moldova and Bosnia and Herzegovina, as well as the EFTA countries Iceland, Liechtenstein and Norway, align themselves with this Council Decision. They will ensure that their national policies conform to this Council Decision. The European Union takes note of this commitment and welcomes it.”

In this context, the planned port calls of the TS Shtandart in Montenegro between 30 June and 3 August 2026 require, in advance, a verification of compliance with the applicable legal framework. The same applies to any related events and port services concerning this vessel.

The provisional programme of the TS Shtandart is available in the annex and on its website [5].

An immediate exchange with the vessel’s operator is necessary in order to anticipate any risk of non-compliance with the European Union restrictive measures framework. This would allow him sufficient time to develop an alternative programme, avoiding the commercial and financial consequences of a last-minute cancellation.

In turn, this would enable the authorities and economic or cultural stakeholders in Montenegro not to enter into commitments that could potentially become detrimental.

This communication is provided for risk awareness purposes. I thank you in advance for your attention to this matter and remain at your disposal for any further exchange or transmission of supporting documentation.

I would also be grateful if you could indicate:

  • whether a compliance assessment has been conducted with regard to Article 3ea of Council Regulation (EU) No 833/2014;
  • whether any internal verification or review procedure is currently underway;
  • which entity is responsible for handling this matter.
