New No Proof Open Class Action with Energy Drinks

The lawsuit alleges that certain ZOA Energy products were misleadingly marketed as containing no preservatives even though the drinks include citric acid and ascorbic acid. Plaintiffs claim these ingredients function as preservatives, making the “0 Preservatives” label deceptive under consumer protection laws. ZOA Energy denies all allegations and maintains that its labeling and marketing complied with applicable regulations. The court has not ruled on the merits of the claims, and the settlement was reached to avoid the expense and uncertainty of continued litigation. As part of the agreement, ZOA Energy has agreed to establish a $3,000,000 settlement fund without admitting wrongdoing.

ZOA Energy is an energy drink brand co-founded by Dwayne “The Rock” Johnson. The brand name is derived from the Polynesian word “toa,” meaning warrior, reflecting Johnson’s Samoan heritage and the company’s branding focus on strength and energy.

The settlement covers United States residents who purchased any ZOA Energy drink labeled “0 Preservatives” for personal use between March 1, 2021 and November 21, 2025. Purchases made for resale or distribution are excluded. Eligible consumers may file a claim for reimbursement based on the number of units purchased during the class period.

Payments are calculated at $1 per unit purchased. Claims submitted without proof of purchase are capped at $10 per household, while claims supported by receipts or other acceptable documentation may receive up to $150 per household. If the total value of approved claims exceeds the funds available after court-approved deductions, payments may be reduced proportionally.

Proof is not required to participate in the settlement, although submitting documentation increases the maximum potential payout. Acceptable proof may include receipts, purchase records, removed UPC codes, or third-party documentation that reasonably demonstrates the date and fact of purchase.

Each household may submit one claim, either online through the official settlement website or by mail. All claims must be submitted or postmarked by February 20, 2026. The deadline to opt out of the settlement or file an objection is February 13, 2026. The court is scheduled to hold a final approval hearing on March 26, 2026.

A specific payment date has not yet been announced. Settlement payments are typically issued after final court approval, resolution of any appeals, and completion of the claims review process by the settlement administrator.

The settlement fund totals $3,000,000 and will be used to cover consumer payments, attorneys’ fees, administrative costs, notice expenses, and any court-approved service awards. Individual payments may vary depending on the number of valid claims submitted.
