The Legal Framework
Redundancy in the UK is not simply a matter of an employer deciding they no longer need a role. It is a legally regulated process with specific obligations at every stage. When those obligations are not met, the redundancy can be challenged — and in many cases, successfully.
Here are the eight questions worth asking.

Did You Receive a Written Reason? You are entitled to a clear, written explanation of why you were selected. Vague language, verbal conversations, or a generic explanation that does not address your specific selection does not satisfy the legal requirement.

Was Consultation Genuine? The law requires meaningful consultation — a real opportunity to challenge the reasoning, explore alternatives, and engage in dialogue before the decision is finalised. A meeting where you are informed of a decision already made is not consultation. Courts and tribunals have been clear on this distinction for decades.

Did Collective Rules Apply? Twenty or more redundancies from one establishment within 90 days triggers collective consultation obligations — including minimum timeframes of 30 to 45 days and the involvement of employee representatives. These are not optional. Failing to comply can result in a protective award of up to 90 days’ pay per employee at tribunal.

Were Selection Criteria Fair? The criteria used to decide who is selected must be objective, measurable, and non-discriminatory. They must be applied consistently and capable of being explained and justified. Where criteria disproportionately affect a protected characteristic — age, disability, pregnancy — they are open to serious challenge.

Were Alternative Roles Offered? An employer who makes someone redundant while vacancies exist elsewhere in the business — without ever discussing those vacancies with the employee — is on difficult legal ground. The obligation to consider suitable alternatives is genuine and must be met before employment ends.

Were Pregnancy and Family Leave Protections Followed? Employees who are pregnant or on family leave sit in a legally protected category. They must be offered suitable vacancies ahead of all other employees. This enhanced protection exists precisely because this group is disproportionately vulnerable during redundancy processes — and it is one of the most frequently breached obligations employers face.

Was There a Grievance Procedure? A fair redundancy process includes a meaningful opportunity to challenge the selection internally — through a formal grievance or appeal, conducted with proper procedures and genuine consideration.

Was Trade Union Activity a Factor? Selecting an employee for redundancy because of their trade union membership or their participation in lawful union activities is not redundancy. It is automatically unfair dismissal — and it carries no qualifying service period requirement.
The Time Limit
Employment Tribunal claims must be brought within three months minus one day of the date employment ended. Before that, ACAS Early Conciliation is required. These deadlines are strict and rarely extended.
