Cher Monsieur Grua,

La Commission accuse réception de vos courriels du 23 avril et du 23 mai 2025 relatif aux activités récentes du Shtandart.

L’interdiction d’accès portuaire des navires battant pavillon russe est en vigueur depuis avril 2022 et s’applique à tous les navires tels que définis à l’article 3 bis, paragraphe 3, du règlement (UE) no 833/2014 du Conseil. Afin de garantir la bonne mise en œuvre des sanctions de l’UE, le champ d’application de l’interdiction en question a été clarifié par le Conseil dans le 14e train de sanctions imposées à la Russie en mentionnant explicitement les répliques de navires historiques. Par conséquent, cette mesure affecte toutes ces répliques, y compris le Shtandart.

Le règlement modificatif [règlement (UE) 2024/1745 du Conseil], y compris les modifications apportées à l’article 3 bis du règlement (UE) no 833/2014 du Conseil, a été adopté par le Conseil, qui seul peut adopter de nouvelles sanctions de l’UE.

Les États membres sont chargés de la mise en œuvre et de l’application des sanctions de l’UE. Nous vous recommandons donc d’adresser ces informations aux autorités nationales françaises en vue de l’application de sanctions [https://www.sanctionsmap.eu/#/main/authorities]. La Commission est prête à soutenir les États membres en cas de question sur la mise en œuvre des sanctions de l’UE.

Subject: Reply — Sanctions alert, Russian vessel “Shtandart”, today, 23 April 2025, in the port of Les Sables-d’Olonne

Dear Mr Grua,

The Commission acknowledges receipt of your emails of 23 April and 23 May 2025 regarding the recent activities of the Shtandart.

The ban on port access for vessels flying the Russian flag has been in force since April 2022 and applies to all vessels as defined in Article 3a(3) of Council Regulation (EU) No 833/2014. In order to ensure the proper implementation of EU sanctions, the scope of the ban in question was clarified by the Council in the 14th round of sanctions imposed on Russia by explicitly mentioning replicas of historic ships. Consequently, this measure affects all such replicas, including the Shtandart.

The amending Regulation [Council Regulation (EU) 2024/1745], including the amendments to Article 3a of Council Regulation (EU) No 833/2014, has been adopted by the Council, which alone is empowered to adopt new EU sanctions.

Member States are responsible for the implementation and enforcement of EU sanctions. We therefore recommend that you forward this information to the French national authorities with a view to the application of sanctions [https://www.sanctionsmap.eu/#/main/authorities]. The Commission stands ready to assist Member States should they have any questions regarding the implementation of EU sanctions.
