Nothing is ever as simple as it appears. When I started in the CBD business, the Genus: Cannabis, Species: Sativa L space mainstream products included Hemp-based CBD Oil products and Marijuana; that was it.
Back then, the differences between CBD and Marijuana were pretty clear. CBD Oil products were focused on creating or being part of wellness solutions.
Even though Marijuana certainly has healthy benefits, its main focus is recreational. When you smoke it, or eat a Marijuana brownie, you get high.
In 2018, some enterprising Hemp chemists in Colorado took advantage of a perceived loophole in the 2018 Farm Bill and developed alternate versions of Delta 9 THC (AKA Isomers) from Cannabidiol (CBD).
Delta 8 and Delta 10 THC-based products also have some health benefits, but similar to Marijuana, their focus is on getting you high at one level or another.
Suddenly, the highly regulated legal Marijuana industry had completely unregulated competition. There was no way this was going to have a happy ending.

Hemp and Marijuana had been illegal until September 2018, when Congress passed the latest Farm Bill, completely removing Hemp from the DEA Schedules, effectively legalizing Hemp.
Almost immediately, two branches of Hemp products appeared in the marketplace: CBD Oil Products and Intoxicating Hemp Products.
Because the 2018 Farm Bill was written the way it was, both started 100% legal, and until recently, were completely unregulated. That is now in the process of changing.
Marijuana is legal at varying levels in different states, either medicinal or recreational, or both. In states where Marijuana is legal, it’s highly regulated and taxed.
However, in December 2025, the Trump administration issued an Executive Order to Re-Classify Medical Marijuana from a Schedule 1 to a Schedule 3 Substance. Many scientists believe that the Medical Marijuana (AKA Cannabis) reclassification could ‘open the floodgates’ for research.
This is a major positive, as many benefits can come from researching a substance that has been misrepresented and even demonized in our culture for well over 100 years. As of May 2026, Marijuana is still illegal at the Federal level.

On April 23, 2026, Medical Marijuana, under certain conditions, was reclassified as Schedule 3. Recreational Marijuana is still classified as Schedule 1.

Federal Marijuana Rescheduling Announced By Department Of Justice, Months After Trump Executive Order.
“Acting Attorney General Todd Blanche on Thursday announced that rescheduling is finally happening. The process will happen in phases, DOJ said.
Under an order signed by Blanche, marijuana products regulated by a state medical cannabis license will immediately move to Schedule III, as will any marijuana products that are approved by the Food and Drug Administration (FDA).
Then, beginning on June 29, there will be a new expedited administrative hearing process to consider the broader rescheduling of cannabis from Schedule I to Schedule III. The Federal Register filing on the hearing says it “will conclude not later than July 15.”

Intoxicating Hemp can relax you and give you a nice, mellow high. However, you need to be careful about what products you purchase and where you purchase them. Avoid buying from a gas station or a convenience store. They have no idea where the products come from or who manufactured them. Only buy from a reputable brand that provides a list of ingredients and a COA. These products are generally not regulated yet, so you need to be extra careful.

Congress adamantly and stupidly refuses to pass the SAFER Banking Act, which would allow legitimate Marijuana companies to open up normal business banking accounts.
It would also qualify a dispensary for normal merchant banking accounts (required for e-commerce) and take credit or debit cards with a normal processing fee rate (e.g., 2.99%).
And BTW, there is a “sin” tax or taxes on every Recreational Marijuana product purchase. It’s impossible to give you a coherent range of taxes because of how different states tax the “Evil Weed”.

Well before the infamous movie, Reefer Madness, Marijuana has been political, one way or the other.
As mentioned earlier in this article, Marijuana is being reclassified from Schedule 1 to Schedule 3, but given the current political climate, I would not expect legalization anytime before 2029.

Some states have legalized Medical and Recreational Marijuana and are enjoying the benefits of the additional tax revenue. Amazingly enough, they are experiencing those same self-righteous politicians attempting to roll back legalization.
Those of us who are pro-legalization need to stay awake, aware, and ready to communicate with our state and federal legislators to keep pushing them in the right direction.

The cannabis plant naturally produces Delta-8 and Delta-10 THC in only trace amounts, making direct extraction impractical for commercial production.

Intoxicating Hemp’s future in the marketplace is no doubt going to change. As of May 2026, it’s in the process of being regulated by many states and, in some states, banned.
Its long-term status is in question, and as of right now, no one really knows how this is going to end.
