The US Supreme Court Rules In Favor of Transgender Segregation in Sports

But don’t give up hope! Law evolves with society.

The Supreme Court have turned back the clock on modern gender science and reintroduced the segregational logic of the Plessy v. Ferguson, an 1896 ruling which legally justified “separate but equal” facilities for blacks and whites.

Justice Kavanaugh speaking for the majority stated:

“They spend extraordinary time and effort to train in the heat and in the cold, to work out early in the morning and late at night, to get a little faster, to become a little stronger, to jump a little higher, to shoot a little better, to watch a little more video, to make the lonely journey back from an A.C.L. tear, to scrap for playing time, to start, to win the game, to win a championship, to hang a banner, to bring home a medal, to be all-tournament, all-County, all-State or all-American … Whether the star of the team or the last player on the bench, they form lifelong friendships and lifetime memories.”

His opinion takes on a different light if you substitute white male athletes for biological female ones in his argument.

According to sociologist Charles E. Hurst :

“Courts often confuse sex, gender, and sexual orientation, and confuse them in a way that results in denying the rights not only of gays and lesbians, but also of those who do not present themselves or act in a manner traditionally expected of their sex”.

Fortunately, the Supreme Court’s decision is not the final word. Law evolves with society. Acceptance of new knowledge takes time.

Desegregation in high school sports evolved over thirty years, from the 1954 Brown v. Board ruling that declared separate schools unconstitutional, to Lee v. Macon County Board of Education in 1967 that forced many Deep South state athletic associations to completely merge their segregated divisions.

The concept of gender will continue to evolve from the singular concept of binary biological sex. It will take continued pressure from the transgender community and its allies to force the courts to show a greater understanding of the concept of human gender versus animal biological sex than it currently has.

Don’t give up.
