Most of us have experienced it — a purchase that didn’t live up to expectations, a service that wasn’t delivered as promised, or a business transaction that simply didn’t go as planned.

While these situations can be frustrating, knowing how to approach a complaint can help you move towards a positive resolution. Nova Scotia Consumer Protection promotes consumer protection through education and awareness. Understanding your rights — and your responsibilities — as a consumer can help you resolve issues more effectively whenever they arise.

Start with the Business

If you have a complaint, your first step should always be to contact the business that sold you the product or service. Most businesses value their reputation and want to keep their customers satisfied. Giving them the opportunity to resolve the issue is often the quickest and easiest path to a solution.

Here are some tips for making your complaint as effective as possible:

Be Prepared

Before contacting the business, gather all relevant documentation, including:

  • Your receipt or proof of purchase,
  • contracts or written agreements,
  • warranty documents,
  • order confirmations,
  • emails, text messages or other correspondence,
  • photos of the product or issue, if applicable.

Make copies of everything and keep your original documents.

Speak to the Right Person

If possible, begin by speaking directly with the employee who assisted you when you made the purchase. A face-to-face conversation often leads to the best results.

If your concern isn’t resolved, ask to speak with a manager. If you’re still unable to reach a satisfactory outcome, escalate the matter by contacting the company’s regional or head office in writing. You can find a business’s mailing address by searching the Nova Scotia Registry of Joint Stock Companies.

Stay Calm and Professional

It’s easy to feel frustrated when something goes wrong, but remaining calm, polite and respectful can go a long way toward achieving a positive outcome.

When discussing your complaint:

  • Clearly explain the problem using the facts.
  • Be honest and avoid exaggerating your claim.
  • Know what resolution you’re seeking, whether that’s a repair, replacement, refund or another reasonable solution.
  • Give the business a reasonable amount of time to investigate and respond.

Many companies have established complaint procedures, so ask whether they have a customer service department or complaint process you should follow.

Know the Business’s Policies

Before requesting a refund or exchange, review the business’s policies and any terms and conditions you agreed to when making the purchase.

For example:

  • Does the business have a return or exchange deadline?
  • Is there a warranty or guarantee?
  • Should you contact the retailer or the manufacturer for repairs?
  • Does your contract include cancellation terms or a cooling-off period?

It’s important to remember that businesses are not automatically required to accept returns simply because you’ve changed your mind. However, if a product is defective or a service wasn’t provided as agreed, you may have rights under consumer protection laws.

Keep Records

Throughout the complaint process, keep detailed notes, including:

  • The dates and times of conversations,
  • the names of employees you spoke with,
  • file or reference numbers,
  • A summary of what was discussed and any promises that were made.

Having a complete record can be extremely helpful if you need to escalate your complaint.

Put It in Writing

If speaking with the business doesn’t resolve the issue, submit your complaint in writing by email or letter.

A written complaint should include:

  • When and where you made the purchase,
  • a clear description of the problem,
  • copies of supporting documents (never the originals),
  • the resolution you’re requesting,
  • a reasonable deadline for a response.

Written complaints create a record of your efforts and may encourage businesses to respond more formally.

If the Business Doesn’t Resolve the Issue

If you’ve made reasonable efforts to work with the business and your complaint remains unresolved, additional help may be available.

Depending on the issue, you may be able to seek assistance from:

Because consumer issues fall under different jurisdictions, it’s important to contact the organization responsible for your particular type of complaint.

Know Your Rights

Consumer protection laws vary depending on the product, service and where you live. Understanding your rights before making a complaint can help you determine whether a business has failed to meet its obligations and where to turn if additional assistance is needed.

Being informed, organized and respectful gives you the best chance of reaching a fair resolution.

A well-prepared complaint not only helps resolve your own issue — it also encourages fair business practices and helps create a stronger marketplace for everyone.
