AI shopping agents are built to convert customers everywhere at once — which means the sales tax problem shows up faster than the growth does.

Somewhere this week, a Shopify store owner switched on a new AI agent that answers customer questions at 3 a.m., recommends products, and closes sales without anyone touching a keyboard. It’s a good tool. Stores like it, on Shopify, WooCommerce, and Magento, are getting these AI layers bolted on constantly now, and the pitch is always the same: more conversions, less staffing, sales that don’t sleep.
Here’s the part nobody puts in the press release. An AI agent doesn’t sell more in your home state and less everywhere else. It sells evenly, to whoever shows up, from wherever they’re browsing. Which means if it works, if it actually does what it’s built to do, your store is about to cross a line most founders have never heard of, in more states than they expected, faster than they planned for.
That line is called economic nexus.
The Math Nobody Markets
Before 2018, a state could only make you collect its sales tax if you had a physical presence there — a warehouse, an office, an employee. Then the U.S. Supreme Court decided South Dakota v. Wayfair, and that changed. Now, most states can require you to register and collect sales tax once you cross a revenue or transaction threshold in that state alone, commonly somewhere around $100,000 in sales, though the exact number and rules shift state by state, and a few still count transaction volume too.
Notice what that threshold measures: a single state. Not your total revenue. Not your home state. Each state watches its own door.
For a founder selling manually, growth tends to be lumpy — a spike here, a slow trickle there, usually concentrated wherever the marketing dollars went. An AI agent doesn’t work that way. It treats a shopper in Ohio the same as a shopper in California, replies at the same quality at 4 a.m. as at 2 p.m., and closes the sale wherever the traffic happens to land. That’s the whole point of it. But it also means the six-figure mark in a handful of states can arrive around the same time, not staggered over years, especially once the store starts running ads that aren’t geographically targeted.
The Part That Trips Up Non-Resident Founders Specifically
If you’re running the store from outside the U.S., there’s a second layer under this one. Registering for a state sales tax permit almost always assumes you already have the basic U.S. business scaffolding in place: an EIN, a registered business entity, sometimes a U.S. bank account tied to that entity. None of that requires a Social Security number or U.S. residency to get. It just has to exist before a state will hand you a permit.
The trouble is the order things usually happen in. A lot of founders open a store first, connect a payment processor, start selling, and only look at the entity and EIN question once something forces it: a payment hold, a bank asking for documentation, or, increasingly, a nexus threshold quietly crossed three states back. By then it’s not paperwork anymore, it’s cleanup — back taxes, penalties, sometimes a voluntary disclosure process to get right with a state before it notices you first.
None of this is really about the AI. The chatbot is just the thing that makes the growth curve steeper and more geographically even than it used to be, which means the gap between “the store is doing well” and “the store has a registration problem” closes faster than it did five years ago. The tools got better at selling. The entity underneath them didn’t get built any faster.
What Actually Matters Here
You don’t need a sales tax permit in every state before you sell a single unit — that would be its own kind of waste. What’s worth doing early, especially if you’re not a U.S. resident, is having the entity and EIN in place before the store scales, not after, so that when a state does come into range, registering is a form to fill out, not a scramble. Most CPAs, and a handful of tools built for exactly this, can track state-by-state thresholds as revenue grows, so it’s not something anyone should be watching by hand.
The AI agent will do its job. It’ll sell more, to more people, in more places. Whether that turns out to be a good problem or a bad one mostly comes down to whether the boring stuff underneath it was ready first.

Questions Founders Keep Asking Me
Do I need to register for sales tax in every state before I start selling? No. Registration is generally triggered per state once you cross that state’s economic nexus threshold, not before. Registering everywhere up front usually just means paying to file a stack of zero returns.

An EIN doesn’t require a Social Security number — non-residents apply through the IRS using an alternate process on Form SS-4.
