Metro Manila’s ₱85 Minimum Wage Hike Suspended by Court: What Employers Need to Know

The implementation of Metro Manila’s historic ₱85 daily minimum wage increase has hit an unexpected legal hurdle after the Pasig Regional Trial Court issued a court order temporarily suspending its implementation following a petition filed by two construction companies. (Philippine News Agency)
The development has prompted many employers to ask the same question:
Do businesses still need to implement the wage increase?
At this stage, the answer depends on the outcome of the ongoing court proceedings. While the wage order has been challenged, the case has not yet reached a final resolution. What is clear is that the dispute has become one of the most significant legal challenges to a regional wage order in recent years.

1 | Why Did Businesses Challenge the Wage Order?
The petition was filed by Readycon Trading and Construction Corp. and R-II Builders Inc., which questioned the legality of Wage Order No. NCR-27.
According to the petition, the Regional Tripartite Wages and Productivity Board–National Capital Region (RTWPB-NCR) failed to sufficiently consider employers’ capacity to pay, one of the factors required under Article 124 of the Labor Code of the Philippines when determining minimum wage adjustments. The companies argued that businesses continue to face mounting operational pressures, including:
- Rising electricity and fuel costs;
- Higher transportation and logistics expenses;
- Softer market demand; and
- Continued financing challenges.
They contend that imposing an immediate ₱85 daily wage increase would significantly increase labor costs, particularly for labor-intensive industries.

2 | Why Has This Wage Increase Drawn So Much Attention?
The controversy stems largely from the size of the adjustment.
Under Wage Order No. NCR-27, Metro Manila workers were granted an ₱85 daily wage increase, making it the largest single minimum wage adjustment ever approved in the National Capital Region. (Department of Labor and Employment)
The increase was designed to be implemented in two phases:
- ₱60 beginning July 25, 2026; and
- An additional ₱25 beginning January 20, 2027. (Philippine News Agency)
The petitioners argue that previous wage adjustments in Metro Manila were generally much smaller, making the current increase unusually significant for employers with large minimum-wage workforces.
For labor-intensive businesses, higher wage costs can affect payroll expenses, project pricing, and overall profitability.
3 | What Does the Court Order Mean?
The issuance of the court order does not automatically invalidate Wage Order No. NCR-27.
Instead, it temporarily suspends implementation while the court determines whether the petition has sufficient legal basis. The merits of the case have not yet been decided. (Reddit)
Following the court’s action, the Department of Labor and Employment (DOLE) said it would respect the judicial process while expressing regret over the suspension of the wage increase. (Philippine News Agency)
Employers are therefore advised to closely monitor further court rulings and official guidance from DOLE and the National Wages and Productivity Commission (NWPC).
4 | Why Could This Case Have Lasting Implications?
Minimum wages in the Philippines are established by the country’s Regional Tripartite Wages and Productivity Boards (RTWPBs) under the Wage Rationalization Act (Republic Act №6727) and the Labor Code of the Philippines. (Department of Labor and Employment)
Historically, wage orders have rarely been subjected to direct judicial intervention.
This case is therefore being closely watched because it could clarify how far courts may review decisions made by regional wage boards, particularly regarding the balance between workers’ welfare and employers’ ability to absorb higher labor costs.
