Implementation of Bill C‑3: New Pathways to Obtain Canadian Citizenship

On December 15, 2025, Bill C‑3, which amends the Canadian Citizenship Act, officially came into effect. This law introduces major changes to citizenship eligibility for individuals born or adopted outside Canada, creating new pathways to obtain Canadian citizenship.

What has changed?

Previously, the Canadian Citizenship Act included a “first‑generation limit.” Under this restriction, a child born outside Canada could only automatically obtain Canadian citizenship if at least one parent was either born in Canada or had obtained Canadian citizenship. This limitation prevented many people with Canadian roots from becoming citizens.

Bill C‑3 removes these restrictions and establishes the following:

• Individuals who were previously denied citizenship due to the old rules — often referred to as “lost Canadians” — are now recognized as Canadian citizens and can receive their official citizenship certificate. • For children born or adopted after December 15, 2025, Canadian citizenship can be passed on even if the Canadian parent was also born or adopted outside Canada, provided that the parent can demonstrate a substantial connection to Canada.

A substantial connection generally means at least three years (1095 days) of physical presence in Canada prior to the child’s birth or adoption.

Why is this change important?

These reforms reflect the realities of today’s globally mobile families and make Canada’s citizenship laws more fair and transparent. Many individuals who were previously unable to acquire citizenship now have a clear legal path to being recognized as Canadian citizens.

This law applies to both past and future situations. Therefore, individuals who previously submitted an application under temporary measures will still be processed under the new rules, and generally do not need to reapply.
