VA.gov has experienced documented technical failures that blocked veterans from submitting Intent to File forms, filing appeals, and updating dependent information — all actions with hard deadlines that affect back pay and benefit calculations. When a government system fails, the burden of proof that you tried to act on time falls entirely on you. Here is how to protect yourself.

What Technical Failures Have Actually Occurred

Congressional investigators documented multiple software errors on VA.gov affecting tens of thousands of veterans. One error prevented veterans from submitting Intent to File forms before a PACT Act deadline. Another blocked access to the Notice of Disagreement form needed to initiate appeals. A third caused dependency update submissions to silently fail without confirmation.

These were not obscure edge cases. They were systemic failures that affected veterans who were doing exactly what the VA told them to do.

Why You Should Never Rely on VA.gov Alone for Critical Submissions

Any submission with a deadline — Intent to File, appeals, dependency updates — should always have a backup submission method. VA.gov is one channel, not the only channel. Using only VA.gov for deadline-sensitive filings is a single point of failure you can easily eliminate.

How to File an Intent to File Without VA.gov

Call 1–800–827–1000 and ask to file an Intent to File verbally. The VA representative will record it and provide you with a confirmation. Get the representative’s name and the confirmation details and write them down immediately.

Alternatively, mail VA Form 21–0966 to your regional VA office by certified mail with return receipt requested. Keep the certified mail receipt and the green return card permanently.

How to Submit Appeals When VA.gov Is Inaccessible

Download the paper form for whichever appeal lane you are using — VA Form 20–0995 for Supplemental Claim, VA Form 20–0996 for Higher-Level Review — and mail it to your regional office by certified mail. Note the date of mailing on your personal records.

How to Document a Technical Failure

The moment you encounter a VA.gov error on a deadline-sensitive submission, take a screenshot that includes the date, time, your browser, and the error message. Save it immediately with a filename that includes the date. If the error occurs close to a deadline, follow up with a phone submission the same day and note the technical failure in your call.

If a deadline was missed due to a documented VA.gov technical failure, submit a reconsideration request to your regional office with your screenshot evidence attached. The VA has a responsibility to accommodate veterans affected by its own system failures.

Use VA.gov as a convenience, not as your only filing method. For any submission with a deadline, always have a backup. Screenshot every online submission attempt. When VA.gov fails, switch immediately to phone or certified mail and document everything.
