Stepfather Sentenced After Forcing 11-Year-Old He Impregnated to Give Birth at Home

Muskogee man receives life in prison for child sexual abuse, child neglect charges

Dustin and Cherie Walker are a Muskogee, Oklahoma couple charged with child sexual abuse and child neglect after an 11-year-old gave birth to a full-term baby at home.

Dustin Walker pleaded guilty to sexually abusing the child and fathering the infant; Cherie Walker faces charges of enabling the abuse.

Muskogee County Assistant District Attorney Janet Hutson said she learned of the case after the child was transported to the hospital. “I was horror-stricken to find out it’s an 11-year-old little girl who’s given birth,” Hutson told reporters.

It has been called the case “one of the most, if not the most, serious child sexual abuse and neglect cases.”

Authorities say the 11-year-old child gave birth to a full-term baby inside the home without ever receiving prenatal care or seeing a doctor during the pregnancy.

“This child is traumatized. She’s been through a horrific ordeal,” the prosecutor said. “I mean, not only has somebody gotten her pregnant, but she gave birth at home without medical assistance, and this will be her life for the rest of her life.”

Assistant District Attorney Janet Hutson said DNA testing showed a “99% certainty” that Walker is the infant’s father and expressed hope that the plea would lead to significant prison time, according to a report from Tulsa NBC affiliate KJRH.

The victim’s biological mother, Cherie Walker, and her maternal grandmother, Michelle Justus, have also been arrested and face charges in connection with the alleged abuse the child endured.

Walker was sentenced to life in prison plus an additional 42 years, according to court records.

Dr. Hoos testified at the sentencing that he had seen all six children who were in the home and described all of them as being severely neglected physically, from lice to dental decay to being underweight.

ADA Hutson showed photos of the home as evidence, described as “depolable” and asked Dr. Hoos if the environment shown increased harm. He said yes.

The home was found to have no AC, no running water, no working toilet, and urine and feces everywhere.

It’s very emotional to realize that a child at the age of 10 and 11 was having sex with their step father, that she became pregnant and no one took her to the doctor and she gave birth at home. When you complicate that with the severe deplorable uninhabitable conditions of that home, to know that’s where she gave birth, where those children lived, without even the ability to get a drink of water in the middle of the night. It affected everyone in law enforcement. It affected the investigators, it affected everyone who touched this case. It certainly affected me.” Prosecuting Attorney Janet Hutson said.

Prosecutors also noted that the 11-year-old victim had been removed from school, with the parents claiming the children were homeschooled, which limited opportunities for teachers or other professionals to intervene.

Dustin Walker entered a blind guilty plea to all seven counts against him: one count of sexual abuse of a child under 12 and six counts of child neglect.

A blind plea in Oklahoma means there is no agreement with prosecutors and the sentence is left entirely to the judge’s discretion.

Walker was sentenced Monday to life in prison plus an additional 42 years, according to court records.

Muskogee County District Judge Timothy King ordered Walker to ***serve the 42-year term first, tied to six counts of child neglect, before beginning the life sentence imposed for one count of sexual abuse of a child under 12.***

Should Walker ever be released on parole, he will be subject to three years of supervision. He is also required to register as a sex offender and is prohibited from having contact with the victims.

The mother, Cherie Walker, faces seven felony charges: one count of enabling child sexual abuse and six counts of child neglect. Her bond was initially set at $100,000, but the court revoked it after a motion by prosecutors, and she has been held without bond since.

Cherie Walker was arraigned, and she waived the reading of the charges. She has not entered a guilty plea, and her case is being tried separately from her husband’s. She is set to go on trial on July 1.

A third defendant, Michelle Justus, the child’s grandmother, was also charged in connection with the case. Prosecutors allege she failed to report the child’s pregnancy or correct the conditions in the home.

Justus faces six counts of child neglect involving each of the six children. Her bond was reduced from $75,000 to $50,000, with conditions including no contact with the victims and no unsupervised contact with any children. She has not entered a plea, and her jury trial is set for July 23, 2026.
