The most common pitfall today is the disclosure of material connection. Gone are the days when you could hide a “thank you @brand” in a sea of thirty hashtags at the bottom of a caption. If your marketing campaign collects user data — even for something as simple as a weekend giveaway — and you don’t have a crystal-clear, legally-compliant consent trail, you are sitting on a regulatory time bomb. Brands are now being held liable for how their third-party agency partners handle this data, making “due diligence” the most important phrase in a marketer’s vocabulary.

The Crackdown on Dark Patterns

India has also taken a world-leading stance against “dark patterns.” These are deceptive design tricks used to manipulate consumer choice. If your website uses “subscription traps” (making it easy to sign up but impossible to cancel) or “false urgency” (the fake “only 2 items left!” countdown timer), you are technically breaking the law. These tactics are now classified as Unfair Trade Practices. For marketers in India, the challenge is no longer just being creative; it’s being compliant. The most successful brands will be the ones that build trust through transparency, proving that you don’t need to trick a consumer to win their loyalty.
