The Financial Breakdown

Because reinstatement was off the table, the Board had to calculate two separate heads of damages:

  1. Wrongful Termination Damages: The Griever was awarded $71,800 for lost income (representing 77 weeks of pay, minus a four-week suspension and partial mitigation).

  2. Compensation in Lieu of Reinstatement: This is where the costs truly mounted. To compensate for the loss of seniority and the enhanced job security found in a unionized environment, the Board awarded $74,750. This was calculated based on two months’ pay for every year of service, plus a 25% top-up to account for the loss of collectively bargained benefits.

  3. Statutory Notice: An additional $6,360 was awarded for six weeks of notice under the Saskatchewan Employment Act.
