Three prongs decide every National Interest Waiver. Know them cold.

The EB2 National Interest Waiver is often pitched as the easier cousin of EB1A. That framing causes real damage. NIW is not a lower EB1A — it is a different test entirely.

Every NIW turns on three questions from the Dhanasar decision. Strong applicants lose because they argue personal merit when they should be arguing national interest.

NIW answers a different question

EB1A asks whether you are among the top of your field. NIW asks whether it is in the national interest to waive the usual job-offer and labor-certification requirements for you. You can be highly accomplished and still fail NIW if you cannot connect your work to a benefit the United States has an interest in advancing.

The three prongs

From Matter of Dhanasar, every NIW must satisfy all three:

1. Substantial merit and national importance. Your proposed endeavor must have substantial merit and importance beyond a local or single-employer benefit. Frame the endeavor, not just your résumé.
2. Well positioned to advance it. You must show — through track record, skills, progress, and a credible plan — that you can actually move the endeavor forward.
3. On balance, beneficial to waive the requirements. It must benefit the country to skip labor certification in your case, for example because your contribution is urgent, unique, or hard to replicate through the normal process.

Where NIW petitions go wrong

The most common failure is arguing personal excellence — prong-one merit — while ignoring national importance and the well-positioned plan. Others submit a vague proposed endeavor that USCIS cannot evaluate, or treat NIW as EB1A with fewer documents, attaching accomplishment lists with no national-interest narrative at all.

Building a strong NIW

Define the endeavor sharply and tie it to a genuine national priority where the connection is honest — critical technology, healthcare, infrastructure, economic competitiveness. Evidence each prong separately so a reviewer can see prong one, two, and three clearly addressed. And lead with a forward-looking plan, not only a backward-looking résumé.

**Bottom line: **NIW is won on national interest, not personal merit alone. Define a specific endeavor, prove you can advance it, and explain why waiving the normal process serves the country.

• Write your “proposed endeavor” in one specific sentence before anything else.
• Map your evidence to all three Dhanasar prongs, not just merit.
• Connect your work to a real national priority without overreaching.
• Include a credible forward plan, not only past achievements.
