Don’t let the internet fool you. All those posts telling you it’s cool to fly with medical marijuana now is super suspect info at best. People are reading headlines and not giving you the full picture.

Here is what you need to know:

On April 27th, the TSA updated its “What Can I Bring?” tool to list medical marijuana as a permitted item. Carry-on and checked bags. Both marked “Yes (Special Instructions).” The special instructions page is completely blank. They built the door and forgot to put a handle on it.

The April 28th rescheduling order did not legalize cannabis. It moved two specific categories to Schedule III: FDA-approved pharmaceuticals like Epidiolex and Marinol, and products regulated under a qualifying state medical license. Everything else is still Schedule I. Same classification as heroin. Your recreational eighth did not get the memo.

So who can actually fly? A documented medical patient with state-licensed product and proper paperwork has a legitimate federal argument at the checkpoint. Everyone else is exactly where they were on April 26th. Some TSA agents don’t even know the law changed yet.

This is where it gets spooky. If TSA officer finds cannabis during screening they can still call local law enforcement. Once local police department shows up THEY have the authority to make the final call, it don’t matter what the TSA website says because they operate under state law.

If you are a documented medical patient with the paperwork to prove it, know your route and know your rights. No guarantees but you do have a leg to stand on. If you are anyone else, leave it at home.
